It is unclear whether or not Mr. Tucker has retained an attorney at this time but he will likely have to appear at the\u00a0Burlington County Superior Court\u00a0in Mt. Holly for his\u00a0Central Judicial Processing (CJP) Court Date.What are Third Degree Invasion of Privacy Charges in New Jersey?In New Jersey, Invasion of Privacy is a criminal offense under N.J.S.A. 2C:14-9. Under this statute, Invasion of Privacy is either a fourth degree criminal offense or a third degree criminal offense. The degree of the charge will depend upon the nature of the conduct and the specific subsection of the statute being charged. In the case mentioned above, we know that the charges are third degree and is either a violation of subsection (b) or (c) of N.J.S.A. 2C:14-9. Those statutes spell out the following:(b) An actor commits a crime of the third degree if, knowing that he is not licensed or privileged to do so, he photographs, films, videotapes, records, or otherwise reproduces in any manner, the image of another person whose intimate parts are exposed or who is engaged in an act of sexual penetration or sexual contact, without that person\u2019s consent and under circumstances in which a reasonable person would not expect to be observed.N.J.S.A. 2C:14-9(b)(c) An actor commits a crime of the third degree if, knowing that he is not licensed or privileged to do so, he discloses any photograph, film, videotape, recording or any other reproduction of the image of another person whose intimate parts are exposed or who is engaged in an act of sexual penetration or sexual contact, unless that person has consented to such disclosure. For purposes of this subsection, \u201cdisclose\u201d means sell, manufacture, give, provide, lend, trade, mail, deliver, transfer, publish, distribute, circulate, disseminate, present, exhibit, advertise or offer.
